Global legal civilization has gradually formed several stable and influential traditional systems in the course of historical evolution. In mainstream general legal cognition, four representative legal traditions are widely recognized and cited worldwide: the Roman civil law tradition, the Anglo-American common law tradition, the Islamic sharia law tradition, and the traditional Chinese law tradition.

This article follows the mainstream public narrative framework, objectively presenting the basic institutional origins, core characteristics, and applicable scope of each legal tradition. The order of introduction follows traditional academic sorting and does not represent the superiority or inferiority of any legal tradition. All legal traditions are recorded as objective historical and cultural legal forms formed by different civilizations.

Roman Civil Law Tradition

The Roman civil law tradition is a codified legal system formed on the basis of systematic written legislation. Its historical origin can be traced back to Roman legal norms, and the Corpus Juris Civilis (Body of Civil Law) completed in 534 CE marks the systematic maturity of ancient Roman law. After being sorted out and inherited in European universities in the Middle Ages, this legal system gradually took shape and became the mainstream legal tradition in continental Europe.

The core feature of civil law is to take unified written codes as the primary basis for judicial judgment and social norm governance. It forms standardized legal logic and unified legal concepts in areas such as legal personality, property rights, and contractual relations. In modern times, this tradition has spread to Latin America, parts of Asia, and other regions, becoming one of the most widely applied legal systems in the world.

It is worth noting that the rediscovery of the Corpus Juris Civilis in 11th-century Italy became a foundational event for the revival of legal studies in Europe. University scholars systematically compiled and interpreted these texts, gradually forming a rationalized and systematic legal knowledge system. This academic tradition not only shaped the legal framework of continental Europe but also provided a basic conceptual tool for later legal codification movements. Anglo-American Common Law Tradition

The Anglo-American common law tradition originated from the judicial trial practice of medieval England. Different from the codified model of civil law, it takes judicial precedents formed in real cases as the important source of legal norms, and follows the core rule of stare decisis — that is, referring to and following previous effective judgments in subsequent trials.

The Magna Carta of 1215 established the basic rule that public power is restricted by law, which has become an important historical origin of the common law tradition. With Britain’s historical overseas expansion and cross-regional cultural transmission, the common law system was introduced to North America, Oceania, South Asia, and other regions, and now forms an independent and stable legal tradition parallel to civil law, covering a large number of countries and populations worldwide.

The common law tradition places particular emphasis on the role of judges as active participants in the formation of law. Through case-by-case adjudication, judges not only resolve individual disputes but also gradually develop and refine legal rules. This case-centered approach gives the common law a strong adaptability, allowing it to respond flexibly to new social situations. Islamic law is a traditional normative system rooted in Islamic classical documents, taking the Quran and Hadith as the core normative basis. It covers all aspects of social operation including religious rituals, family relations, civil contracts, property inheritance, and criminal norms, forming a complete and self-consistent traditional legal system.

In the historical development process, legal scholars formed multiple schools of interpretation according to social practice, forming diversified and systematic jurisprudence interpretation systems. In regions with Islamic cultural traditions, sharia norms have long guided local daily social operation and civil and commercial activities. In modern society, most regions inheriting this tradition adopt a hybrid legal mode combining traditional norms and modern statutory laws.

The formation and development of Islamic law reflect a distinctive feature: the integration of legal norms with religious ethics. The legal system is not viewed as a purely secular tool but as part of a comprehensive way of life that includes spiritual and moral dimensions. This integration has given Islamic law a strong continuity and influence in societies where it has taken root, and continues to interact and integrate with various modern legal frameworks worldwide.

Traditional Chinese law is a legal and governance system formed under the influence of traditional Chinese ethical culture, with the core institutional feature of the integration of ritual norms (Li) and penal laws (Fa). It takes moral education and social etiquette norms as the basic way to maintain social order, and statutory penal codes as the supplementary constraint mechanism for social governance.

The Tang Code of 653 CE is the most systematic and representative classic legal document of traditional Chinese law. Its normative system and governance concepts were spread and learned by East Asian countries in history, forming a unique traditional legal civilization in East Asia. This system covers official governance, civil customs, criminal punishment, grassroots mediation, and other social governance contents, which is a localized legal tradition formed by the long-term development of Chinese civilization.

In traditional Chinese legal thought, law was generally understood not as an independent domain separated from ethics but as an extension of the moral order. The legal system operated in tandem with the ritual order, with rituals guiding behavior and law stepping in when education and moral suasion fell short. This conceptual framework had a lasting influence on the legal traditions of neighboring societies and continues to inform discussions of legal culture in East Asia today.
